The customer/distributor fully understands and approves that this contract, all conditions and any related documents are written in English. You must read and agree to these terms and conditions before you may access or view this site. By visiting this site, you are agreeing to all of the terms of this agreement. This agreement is subject to change at any time, and changes are effective upon posting.If you have tried a product and it is defective, we will offer you an exchange in the first 10 days. If you are willing to upgrade your equipment in the first 60 days following delivery of your equipment, we will charge you only for the difference in price between your equipment and the new one at the suggested retail price plus shipping and handling fees. We will give you the opportunity to upgrade your equipment between 61 and 180 days after delivery of the equipment by giving you a credit corresponding to 50% of your original purchase price less delivery fees for a brand new equipment at the suggested retail price.Inter-City Medical warrants the customer that products purchased hereunder will conform to the applicable manufacturer’s specifications for such products.
Certification Section and Conditions
Inter-City Medical will not export any of its equipment that can violate, to the best of its knowledge, the laws and certification requirements of the country. The Client or Distributor shall comply with all Applicable Laws existing in the Territory from time to time concerning the Products and shall keep Supplier informed of any relevant changes therein. In particular but without limitation Distributor / Customer (i) shall at its own expense obtain all necessary permissions, consents and licenses to enable client or Distributor to market, sell, buy or use the Products in the Territory; (ii) shall obtain any other governmental or other permission, consent or license or make any registration necessary for the full and legal operation and performance of this Contract; (iii) shall be responsible for the management of the importation of the Products into the Territory in compliance with Applicable Laws and the payment of all applicable import duties, taxes and other charges, and shall promptly upon Supplier’s request provide to Supplier copies of all documents evidencing the same. Client or Distributor acknowledges and confirms they have verified that the Products acquired comply with all Applicable Laws existing in its Territory or in any territory the client or distributor shall sell, rent or use the equipment. The Distributor / Customer confirms that all applicable laws and regulations , including specific custom requirements or taxes in his country and including any other additional expenses, fees or any documentation have been checked prior to purchase. The equipment listed in our website is HEALTH CANADA and FDA APPROVED. Our IPL Equipment are certified, Inter-City Medical / Medicam received the Official CCN, ISO and certifications on all Inter-City Medical IPL Equipment and CAN BE SOLD, PURCHASED AND USED IN the USA and CANADA. All IPL Inter-City Medical Equipment is CE Medical and Esthetic APPROVED also. Please refer to the webpage in our website (certification section) for the certifications. All terms and conditions and/or all sections of the website have been read and fully understood before ordering or using any of our equipment. At no time and under no circumstances a customer/distributor will pretend that he/she did not understand any of the terms and conditions and/or sections because he/she did not correctly speak the language in which any of the terms and conditions and/or sections were written. Our websites are translated in several languages but unfortunately cannot be in all languages.
Payment and Delivery Terms
We accept payment by certified checks, Bank money order, International postal money order, and wire transfer. Any deposit made to reserve a unit is not refundable. Any paid amounts, monthly payments are not refundable and the customer/distributor will have to return to our location the rented or leased equipment at its own expense and in its original packaging to end the contract. Not doing so will result in a lawsuit to get the remaining amounts up to the full payment of the unit including any applicable taxes. If Payment is made from a foreign country, customer may inquire for the applicable rate to convert currency in Dollars. Exchange may not be daily rate since Inter-City Medical is not manufacturing its inventory at the time of the current order. Total amount to be paid in full unless agreed and mentioned on the terms of the contract. A $35.00 return check fee applies to all non-collectible checks. Inter-City Medical reserves the right to electronically retrieve NSF, Stop Pays, and other non-collectible funds from your account. Shortages surcharge apply, except when special services are requested. Puerto Rico imposes a 6.6% excise tax, which is not collected by Inter-City Medical Inc. Alaska; Hawaii & Pacific Islands customers are responsible for any applicable taxes. International customers are responsible for applicable duties and/or taxes in their country.
Delivery and Title
Inter-City Medical will make reasonable efforts to initiate shipment and schedule delivery as close as possible to customer’s request delivery date(s). Customer acknowledges that delivery dates provided by Inter-City Medical are estimates only and that Inter-City Medical Inc will not be liable for failure to deliver on such dates and time. We may make selection of the carrier and delivery route unless specifically designated in writing by the customer. Inter-City Medical may decide without customer’s consent to ship the product in express delivery and charge said customer for such shipping method difference. Extreme weather conditions may oblige Inter-City Medical to select other transport options for customer’s and equipment protection. The customer/distributor in addition to the purchase of the product shall pay all transportation charges from Inter-City Medical Shipping premises and the customer/distributor will have to take enough insurance coverage to cover the total value of the equipment in case of any incident (check part and warranty conditions). Any equipment held at the customer country government customs will be the sole responsibility of the customer/distributor and Inter-City Medical or any of its branches or affiliates will consider the unit delivered. All equipment are tested and verified before shipping and are in perfect working order. If an equipment is delivered defective due to delivery delays of any kind, the customer/distributor will have to return the equipment at his/her own expenses and will have to assume the costs for the repairs of the purchased equipment. Subject to our right of stoppage in transit, delivery to a carrier will constitute delivery to customer, and risk of loss will thereupon pass to the customer; however, title shall remain in Inter-City Medical until the customer makes payment in full for the product. Products invoiced and held by Inter-City Medical at customer’s request will be held at customer’s risk and expense.Delivery of any installment of product within sixty (60) days after the date requested and order confirmed will constitute a timely delivery. Delivery of a quantity which does not vary by more than ten percent (10%) from the ordered quantity will constitute full performance of such delivery. Delay in delivery of one installment will not entitle customer to cancel that installment. Customer is responsible for all imports taxes, tariffs, levies, or fees.
Statements and Advice
If statements or advice, technical or otherwise, is offered or given to customer, such statement or advice will be deemed to be given as an accommodation to customer and without charge and Inter-City Medical will have no responsibilities or liabilities whatsoever for the content or use of such statements or advice.
Inter-City Medical will not be liable for delays in delivery or for failure to perform its obligation due to causes beyond its reasonable control, including, but not limited to, product allocations, material shortages, labor disputes, transportation delays, unforeseen circumstances, acts of God, acts or omissions of other parties, acts or omissions of civil or military authorities, government priorities, customs delays, clearance delays, fire, strikes, floods, epidemics, quarantines restrictions, riots, or war. Inter-City Medical time for delivery or performance will be extended by the period of such delay or Inter-City Medical may, at its option, cancel any order or remaining part thereof without liability by giving notice to customer. Discounted equipment or on sale usually generates a very high volume of sales and may cause a delivery delay. A delivery within Sixty (60) days after payment will constitute a timely delivery.
The terms and conditions may not be modified or cancelled without Inter-City Medical written agreement. Before any order, you acknowledge having read, understood and approved all the above terms and conditions, all related sections and/or terms and conditions of our websites and all warranty sections. The sale of products hereunder will be governed by the terms and conditions, notwithstanding contrary or additional terms and conditions in any purchase, planning schedule, acknowledgement, confirmation or any other form or document issued by either party effecting the purchase and/or sale of products. Inter-City Medical, any of its branches or affiliates, reserve the right to adjust, modify, cancel or add any term and/or condition and/or clause of any kind without prior notice.
